1. Acceptance of Terms
By accessing and using Cardova ("Service"), you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use our Service.
2. Service Description
Cardova provides digital business card creation, management, and sharing services. Our Service includes:
- Creation and management of digital business cards
- QR code generation for sharing contact information
- Integration with Apple Wallet and Google Wallet
- Real-time card updates and analytics
- vCard generation and contact export
2.1 Free Tier
We offer a free tier that includes:
- One (1) digital business card
- Basic card customization
- QR code generation
- Wallet integration (Apple Wallet & Google Wallet)
- Contact information sharing
No credit card is required to create and maintain a free account.
3. Account Terms
3.1 Account Creation
- You must be at least 18 years old to use this Service
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account
- You are responsible for all activities under your account
- You must immediately notify us of any unauthorized use
3.2 Account Responsibilities
- One person or legal entity may maintain no more than one free account
- You may not use the Service for any illegal or unauthorized purpose
- You must not transmit any worms, viruses, or destructive code
- You are responsible for all content posted under your account
4. Subscription & Billing
4.1 Paid Plans
Paid subscription plans (Pro and Business) are billed through Stripe:
- Monthly billing: Charged monthly on subscription anniversary
- Annual billing: Charged annually with discounted rate
- Automatic renewal: Subscriptions renew automatically unless cancelled
- Price changes: We will notify you 30 days before any price changes
4.2 Cancellation & Subscription Downgrades
- You may cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- No refunds for partial months or unused time
- Upon downgrade from Pro/Business to Free plan:
- You will be prompted to select which card to keep active
- Free plan allows 1 active business card
- Additional cards will be disabled at the end of your billing period
- Disabled cards remain in your account but cannot be edited or shared
- Wallet passes for disabled cards will no longer receive updates
- You can re-enable cards by upgrading back to a paid plan
- If you cancel through Stripe's billing portal without selecting a card:
- Your oldest card will automatically be kept active
- Remaining cards will be disabled as described above
4.3 Payment Information
- All payments are processed securely through Stripe
- You authorize us to charge your payment method
- You are responsible for all applicable taxes
- Failed payments may result in service interruption
4.4 Wallet Pass Live Updates
- All digital business cards include technical capability for live updates
- Active live updates (real-time synchronization) is a Pro/Business feature
- Free plan cards do not receive live updates during normal operations
- We reserve the right to push updates to wallet passes for:
- Security updates
- Compliance requirements
- Enforcing plan limits (e.g., disabling passes when subscription ends)
- Preventing abuse or unauthorized use
5. Intellectual Property
5.1 Our Property
The Service and its original content, features, and functionality are owned by ByteInk and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
5.2 Your Content
- You retain all rights to content you upload (logos, photos, contact information)
- You grant us a license to use your content to provide the Service
- You represent that you have the right to upload all content
- You are responsible for ensuring your content does not infringe on others' rights
6. Wallet Pass Usage
6.1 Apple Wallet & Google Wallet
- Wallet passes are generated for compatible devices
- We comply with Apple and Google wallet specifications
- Pass updates are subject to platform availability
- We are not responsible for platform-specific limitations
6.2 Pass Data
- Wallet passes contain your contact information
- Pass data is transmitted securely
- Recipients control how they use your information
- You can revoke or update passes at any time
7. Privacy & Data Protection
7.1 Data Collection
We collect and process personal data as described in our Privacy Policy. By using the Service, you consent to our data practices.
7.2 Data Security
We implement industry-standard security measures, but no system is 100% secure. You use the Service at your own risk.
7.3 Data Deletion
You may request account deletion at any time through your settings. Deletion is permanent and irreversible.
8. Analytics & Tracking
We collect analytics data to improve the Service:
- Card view statistics
- Geographic information (country-level)
- Device types (iPhone, Android, etc.)
- Referral sources
All analytics are anonymized and aggregated.
9. Prohibited Uses
You may not use the Service to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit harmful or malicious code
- Harass, abuse, or harm others
- Collect data from other users without consent
- Impersonate any person or entity
- Interfere with or disrupt the Service
- Attempt to gain unauthorized access
10. Service Availability
10.1 Uptime
We strive for high availability but do not guarantee uninterrupted access. The Service may be unavailable for:
- Scheduled maintenance
- Emergency updates
- Technical issues beyond our control
- Force majeure events
10.2 Modifications
We reserve the right to:
- Modify or discontinue features
- Update these Terms with notice
- Change pricing with 30 days notice
- Suspend accounts for Terms violations
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED AMOUNTS PAID BY YOU IN THE PAST 12 MONTHS
- WE ARE NOT LIABLE FOR THIRD-PARTY ACTIONS (Apple, Google, Stripe, etc.)
- WE ARE NOT RESPONSIBLE FOR DATA LOSS OR SERVICE INTERRUPTIONS
12. Indemnification
You agree to indemnify and hold harmless ByteInk, Cardova, and our affiliates from any claims, damages, losses, liabilities, and expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of others
- Your content and data
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the jurisdiction where ByteInk is registered, without regard to conflict of law provisions.
13.2 Arbitration
Any disputes shall be resolved through binding arbitration, except for:
- Claims for injunctive relief
- Intellectual property disputes
- Small claims court matters
13.3 Class Action Waiver
You agree to resolve disputes on an individual basis and waive the right to participate in class actions.
14. Termination
14.1 By You
You may terminate your account at any time by deleting it in your settings.
14.2 By Us
We may terminate or suspend your account immediately if you:
- Violate these Terms
- Engage in fraudulent activity
- Cause harm to the Service or other users
- Fail to pay for subscriptions
14.3 Effect of Termination
Upon termination:
- Your right to use the Service ends immediately
- Your data will be deleted per our retention policy
- Outstanding payments remain due
- Certain provisions survive (liability, indemnification, etc.)
15. Miscellaneous
15.1 Entire Agreement
These Terms constitute the entire agreement between you and Cardova regarding the Service.
15.2 Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
15.3 No Waiver
Our failure to enforce any right does not waive that right.
15.4 Assignment
You may not assign these Terms. We may assign our rights without notice.
15.5 Force Majeure
We are not liable for failures due to circumstances beyond our reasonable control.
16. Updates to Terms
We may update these Terms from time to time. We will notify you of material changes via:
- Email notification
- In-app notification
- Website banner
Continued use after changes constitutes acceptance.
